Professor Paul M. Kohlhoff and student representative David Shanks (3L) recently settled an innocent spouse case with the IRS. Their client was jointly liable with her ex-husband for a 2002 income tax liability in excess of $29,000. The IRS denied the client's request for equitable innocent spouse relief and the client filed a petition with the United States Tax Court. Under the settlement, the IRS agreed to grant the client full innocent spouse relief and to refund her approximately $16,000 in payments she already made to the IRS.
